By creating an account on My Social Fanatics, whether through a mobile device, mobile app, or computer (collectively the "Service"), you agree to be bound by (i) these Terms of Use and (ii) the Privacy Policy and the File Policy. Cookies, arbitration procedures (if they apply to you), safety guidelines, and social media guidelines, each of which are incorporated by reference into this Agreement, and (iii) any terms that are made clear to you and that you agree to when you purchase additional features, products, or services that we make available through the Service (together referred to herein as the "Agreement"). Please stop using our services If you do not accept or agree to be bound by all of the terms in this Agreement.
We may make changes or amendments to this Agreement from time to time. There may be a variety of reasons, including to reflect changes in the law or its requirements, new features or changes in business practices. The latest version of this Agreement will be posted on the Service under Settings, as well as on my Social Fanatics.com, and you should regularly check for the latest version. The latest version is the applicable version. We will notify you through email or other means at our discretion if changes affect your rights or obligations. Furthermore, we will notify you at least 30 or so days before the changes are made (unless we are unable to do so under local law) via a reasonable means, which can include notification through email or our services. You will be deemed to agree to the revised/modified Agreement if you continue to use our Service after the changes have become effective.
To be able to use My Social Fanatics, you can log in by several means, including logging in with your Facebook account. If you do so, you allow us to access and use certain information in your Facebook account, including but not limited to your public Facebook account. To know more about our policy regarding information collection and how we use the information, please refer to our Privacy Policy page.
You are held responsible for securing and maintaining the confidentiality of your login credentials that you use to log into My Social Fanatics, and you are solely responsible for all activities that occur under those credentials. If you believe your account credential security has been compromised or someone has gained unauthorized access to your account, please contact us immediately.
My Social Fanatics is always striving to improve the Service and to give you additional functionality that you will find attractive and useful. This means that we may add new product features or improvements from time to time, as well as remove some features, and if such actions do not materially affect your rights or obligations, we may not provide you with prior notice. We may suspend the Service entirely, in which case we will notify you in advance unless extenuating circumstances, such as security or safety concerns, prevent or inhibit us from doing it so.
You may delete temporarily or terminate your account at any time, for any reason, by following the instructions in Settings in the Service. However, if you are using a third-party payment account, such as Apple App Store, iTunes, as applicable ("App Store"), or Google Play Store, you will need to manage your in-app purchases through that account to avoid additional billing. My Social Fanatics may close your account at any time without notice if it believes that you have violated this Agreement. You will not be entitled to a refund for any purchase if the account is closed.
After your account is terminated, this Agreement will also terminate, but the following provisions will still apply to you and My Social Fanatics: Although My Social Fanatics strives to encourage a respectful member experience through features such as dual-sharing that only allow communication between members if they are interested in each other, it is not responsible for the conduct of any member on or off the Service. You agree to use caution in all dealings with other Members, in particular, if you decide to communicate with them outside of the Service or meet with them in person.
Moreover, you agree to review and follow My Social Fanatics safety guidelines before using the Service. You agree not to give your confidential information such as financial information (for example, your credit card or bank account information) or in any way transfer or transfer money to other members.
You understand that My Social Fanatics does not conduct criminal investigations on its members or in any way investigate its members backgrounds. Therefore, you are solely held responsible for your interactions with other Members. My Social Fanatics makes no representations or warranties as to the conduct or compatibility of members.
By creating an account, you grant My Social Fanatics a worldwide, transferable, sublicensable, royalty-free right and license to host, store, use, copy, display, reproduce, and format the information you have authorized us to access through a third party such as Facebook.
Edit, post, modify and distribute it, as well as any information you post, upload, display or make available (collectively, "Posting") on the Service or transmit to other Members (collectively, "Content").
My Social Fanatics license to your content shall be non-exclusive, and otherwise, My Social Fanatics license shall be exclusive to derivative works created through the use of the Service.
For example, My Social Fanatics holds an exclusive license to screenshots of the Service that include your content. In addition, in order for My Social Fanatics to prevent the use of your content outside of the Service, you authorize My Social Fanatics to act on your behalf with respect to the infringement of use of your content taken from the Service by other Members or third parties . This expressly includes the authorization, but not the obligation, to provide notices pursuant (that is, notices of deletion of intellectual property infringement) on your behalf if your content is taken and used by third parties outside the Service.
Our licensing of your content is subject to your rights under applicable law (for example, laws relating to the protection of personal data to the extent any Content contains personal information as defined in those laws) and for the limited purpose of operating, developing, providing, improving and researching another new service and develop it. You agree to allow other members, and anyone who visits or participates in the Service, to view any Content that you have placed or authorized us to place on the Service (such as individuals who may receive shared content from other My Social Fanatics members).
You acknowledge that all information you provide when creating your account, including information provided by your Facebook account, is true and truthful, and you have the right to post content on the Service and to grant the aforementioned license to My Social Fanatics.
You agree and understand that we may monitor or review any Content you post as part of the Services. We may remove any Content, in whole or in part, if it, in our sole discretion, violates this Agreement or may damage the Service reputation.
You acknowledge your commitment to respect and public morals when communicating with our customer service representatives. We hold the right to immediately terminate your account if we feel that your behaviour towards any of our customer service representatives or other employees is at any time threatening, harassing or offensive.
By allowing My Social Fanatics to use the Service, you agree that we, our affiliates and our third-party partners may place advertisements on the Service. By submitting suggestions or feedback to My Social Fanatics regarding our Service, you agree that My Social Fanatics may use and share such feedback for any purpose without compensation to you.
Please note that My Social Fanatics may access, retain and disclose your account information and content if required to do so by law or by enforcement of its Agreement with you or if it believes in good faith that such access, retention or disclosure is necessary to achieve legitimate interests, including ( 1) adherence to legal process procedures; or (ii) execute this Agreement; or (iii) respond to claims alleging the existence of any content that infringes the rights of third parties; or (iv) respond to your concerns, or any requests for customer service; or (v) to protect the property, personal safety, or intellectual property of the Company or any other person.
A. Legal Interests :
Although My Social Fanatics reserves the right to review and remove content that violates this Agreement, such content is the sole responsibility of the member who posted it, and My Social Fanatics does not guarantee that all content will comply with this Agreement.
If you notice any content that violates our terms of use or violates this Agreement, please report it through the Service or via the Contact Us page.
Generally, from time to time, My Social Fanatics may offer products and services for purchase ("In-App Purchases") through the App Store, Google Play, carrier billing, My Social Fanatics direct billing, or other payment platforms authorized through My Social Fanatics. If you like to make an in-app purchase, you will be prompted to confirm the purchase with the appropriate payment provider, and your payment method (whether its your card or a third-party account such as the Google Play Store or the App Store) (your "Payment Method") will be charged at the price, Subject to the prices offered to you for the Service (s) you have chosen and any sales or similar taxes that may be levied on your Payments, you authorize My Social Fanatics or the third-party account, as necessary, to charge you the funds.
If you purchase a periodic subscription that automatically renews through the in-app purchase, your payment method will still be charged for subscription renewal until you cancel it. After the subscription commitment period begins and again after any subsequent subscription period, your account will automatically continue for an additional equivalent period at the same price you agreed to when you signed up. Understand that your payment card information will be stored and used later for automatic renewal of payments as per this Agreement.
Any objections regarding payment already made should be directed to Customer Support if you have been billed directly from My Social Fanatics or a related third-party account such as the App Store. You can also object by contacting your bank or payment service provider, who can provide more information about your rights as well as about applicable time limits. You may also unconditionally withdraw your consent to Automatic Card Payments at any time by going to Settings on your My Social Fanatics account or relevant third-party account; However, you should know that you are still obligated to pay any amounts due.
If you wish to change or terminate your subscription, you will need to sign in to your third-party account (or settings in My Social Fanatics, if applicable) and follow the instructions to terminate or cancel your subscription, even if you delete your account with us or delete the My Social Fanatics app from your device. Deleting your My Social Fanatics account or deleting the My Social Fanatics app from your device does not terminate or cancel your subscription; My Social Fanatics will keep all funds charged to your Payment Method until you terminate or cancel your My Social Fanatics subscription or third-party account, as applicable.
If you opt-out, terminate or cancel your subscription, you may use your subscription until the end of the then-current subscription term, and your subscription will not renew after the then-current term expires.
Additional terms apply if you pay directly to My Social Fanatics using your payment method. If you pay to My Social Fanatics directly, My Social Fanatics may correct any billing errors or errors even if it has already requested or received payment. If you initiate a chargeback or refund your Payment Method, My Social Fanatics may immediately terminate your account at its sole discretion.
You can edit your payment method information by visiting My Social Fanatics and going to Settings. If payment is not successfully settled, due to expiration, insufficient funds or otherwise, and you do not modify your Payment Method information or terminate or cancel your subscription, you remain responsible for any uncollected funds and authorize us to continue to debit your Payment Method, which can be updated. This may result in a change in the dates that your payment invoices are issued. In addition, you authorize us to obtain the expiration dates as well as updated and alternate card numbers for your credit or debit card provided by your credit or debit card issuer. Payment terms depend on your payment method and may be determined by agreements between you and the financial institution, credit card issuer or other providers of the payment method you choose.
You acknowledge that MY SOCIAL FANATICS is not required to refund payments for Virtual Items for any reason and that you will not receive money or other compensation for unused Virtual Items upon account closure, whether voluntary or involuntary.
In general, all fees for in-app purchases are non-refundable, and there are no refunds for payments or credits for partial periods of use. We may make an exception to a refund if a subscription offer is requested within fourteen days of the transaction date or if the laws in your jurisdiction allow refunds.
For subscribers residing in the European Union or the European Economic Area, you are entitled to a full refund within 14 days after the start of the subscription, in accordance with local law, without giving reasons. Please note that this 14-day period begins after you start.
You may not cancel an order to deliver digital content that has not been delivered through a physical medium if the order processing process has begun after you have obtained your prior express consent and acknowledgement that you will, in this way, lose your right to cancel. This applies, for example, to the purchase of virtual items. This means that these purchases are final and cannot be refunded.
If you believe that your work has been infringed, copied and posted on the Service in a manner that constitutes copyright infringement, please submit a notice of content removal using the form found here.

MY SOCIAL FANATICS PROVIDES THE SERVICE ON AN "AS IS" AND "AS AVAILABLE" BASIS AND TO THE EXTENT PERMITTED BY APPLICABLE LAW, AND MAKES NO WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, WITH RESPECT TO THE SERVICE (INCLUDING ALL contents thereof) including, without any limitation, any implied warranties of satisfactory quality, merchantability, or specific particular purpose or non-infringement.
MY SOCIAL FANATICS does not represent or warrant that (a) the Service will be uninterrupted, secure or error-free, (b) any defects or errors in the Service will be corrected, or (c) the content or information obtained by you from or through the Service will be accurate.
My Social Fanatics assumes no responsibility for any Content that you or any other member or third party sends or receives via the Service. Your access to any material uploaded or otherwise obtained through the Service is at your own risk.
The Service may contain advertisements and promotions provided by third parties and links to other websites or resources on the Internet. My Social Fanatics is not responsible for the availability (or unavailability) of these external websites or resources. If you choose to engage with third parties made available through our Service, that party terms will govern its relationship with you. My Social Fanatics is not responsible for or subject to the terms or procedures of such third parties.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MY SOCIAL FANATICS, ITS AFFILIATES, EMPLOYEES, INCIDENTAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES SHALL BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXCLUSIVE, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES or enhanced, including without limitation, loss of profits, whether incurred directly or indirectly, or any loss of data, use, reputation, or other immaterial loss, resulting from (I) your access to the Service use of, or inability to access or use it; (II) the conduct or content of other users or third parties on, through or in connection with their use of the Service; OR (III) any unauthorized access, use, or modification of your content, even if my social fanatics has been advised of the possibility of such damages. my social fanatics entire liability to you for all claims related to the service will not, under no events, exceed the amount paid by you to my social fanatics.
You agree to insure, defend, and hold My Social Fanatics, our affiliates, and their officers, directors, agents, and employees harmless from and against any and all complaints, demands, suits, damages, losses, costs, liabilities and expenses, including attorney fees, arising out of, or arising from for any form of access to or use of the Service, or Your Content, or breach of or relating to this Agreement.
This Agreement, which includes the Privacy Policy, Cookie Policy, Safety Guidelines, Social Media Guidelines, contains in addition to any terms disclosed and agreed to when you purchase additional features, products, or services we offer at The Service, the entire agreement between you and My Social Fanatics regarding the use of the Service. If any provision of this Agreement is held to be invalid, the remainder of this Agreement will remain in full force and effect. The failure of the Company to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. You agree that your My Social Fanatics account is non-transferable and that all rights to your account and its contents terminate upon your death. No agency, partnership, joint venture, fiduciary relationship, or other proprietary relationship or business arises as a result of this Agreement, nor may you represent or make any representations on My Social Fanatics behalf in any way.
